It is to be noted that with the exception of item 5

in the second schedule, the second schedule relates to leasehold

properties equally with the first schedule.

In connection with item 5 in the second schedule

there is some doubt as to its tenure. It was mentioned by you

in your letter under reference and I shall be glad if you will

kindly confirm that this lot is leasehold as it does not appear

to be mentioned in the Lewis Memorandum as such.

It is further requested that the following additions

be made to the draft:-

(i)

(ii)

A preamble reciting the fact that the War Department

has been in occupation of this area for many years

prior to the date of the Memorandum.

The words "or any later modifications thereof" be

added after the reference to the Circulars of 1890

and 1894.

With regard to (i) above I suggest that the preamble

might be on the following lines:-

"Whereas the piece or parcel of ground referred to

"hereinafter as Colonial Military Land has been in

"the possession of the War Department for many years

"and whereas no title deeds exist It is now agreed

"that in order to regularise the tenure a formal

"Memorandum of Transfer shall be entered into So be

"it remembered that His Excellency the Governor

"acting for and on behalf of the Colonial Government

"of Hong Kong DOTH hereby transfer and make over to

"His Majesty's Secretary of State for War as Colonial

"Military Land with the right of perpetual user until

"no longer required for Military purposes ALL that

"etc., etc.

In view of the important War Department buildings

within the Victoria Cantonment area which have not been provided

and
